Website Data Loss/Whole Website Data Vanished:

We are not responsible for any/whole website data loss/corruption. Data loss due to hardware failure or in any situation, so always take your website backup in your local drive. Server Upgradation, Software Updation/Testing, Modules Testing/Implementation may happen from time to time. For this purpose sometimes we need to down some services for a certain period. If in case of any upgrade, the customer May or May not be informed 24 hours before the downtime. This kind of downtime will not be counted as Server Downtime. We improve the servers/software/security/modules.

In this Age and Day Website Hacking is a serious problem, we try to do our best to provide security against such threats but no website is 100% secure against such threats due to any possible reasons (please read articles online related to this to better prepare for it) but if your website is hacked then we are not responsible for that and we will try our best to restore your website if you bring this to our attention but can’t 100% guarantee that it will be restored to the previous state it was before hacking, and please try to take backup of your website every week or whenever you make changes to your website in case the website is unrecoverable from the hacking/data loss, then we can use that backup to restore your website else we will use the backup of the delivery date to restore your website and we will not be responsible for any data loss, due to the older backup file.

Emails marked as Spam:

Your emails may sometimes be marked as Spam or may land in the Spam folder of the receiver’s Email address. This happens when your email is not having correct DKIM, SPF records or if you exceed the daily/hourly outgoing email quota. Also, sometimes big email companies like Gmail, Yahoo temporarily blacklist Shared Hosting Server IP addresses. Due to this reason, your emails may land in the spam folder of the receiver’s email address.

Use external email clients like SendGrid to overcome this issue.

Viruses & Other Destructive Activities:

Use of Firstveda & its Subsidiaries’ services or equipment for creating or sending Internet viruses, worms, or Trojan horses, or for pinging, flooding, or mail-bombing, or engaging in denial of service attacks is strictly prohibited.

Malicious Website or Website Hacked:

We provide Imunify360 Malware & Virus Protection software. As you are the owner of your website, it is your responsibility to make your website secure by regularly scanning your site. We will not take any kind of responsibility if your website gets infected or hacked. We have add-on packs to secure your website from our end for one time.

Illegal Use:

Firstveda & its Subsidiaries services must be used for lawful purposes only. Transmission, storage, or distribution of any information, data, or material in violation of any applicable law or regulation or that may directly facilitate the violation of any particular law or regulation is prohibited. This includes, but is not limited to: copyrighted material; trademarks; trade secrets, or other intellectual property rights used without proper authorization; material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.

System and Network Abuse:

Violations of system or network security are prohibited and may result in criminal and civil liability. Examples of system or network security violations include, without limitation the following: unauthorized access to or use of data, systems or networks; interference with service to any user, host, or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks; forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.

Pornography:

The use of Onohosting.com’s services to store, post, display, transmit, advertise, or otherwise make available any type of pornography is prohibited. If We find any movie/video/Audio/Mp3, your Account will be Suspend/Terminate without any Notification.

Anti Piracy:

Web Hosting and E-Commerce accounts should not be used to distribute illegal or pirated software/files/information. Firstveda & its Subsidiaries services are provided on an as-is, as available basis without warranties of any kind, either expressed or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement. Firstveda & its Subsidiaries.com and its partners and suppliers will not be liable for any cost or damage arising either directly or indirectly from any transaction or use of the service.

Payment:

Firstveda & its Subsidiaries, reserve the right to suspend the services if the payments are not made by the due date. We shall not be held liable for any kind of loss due to the disruption of services. Our pricing may increase or decrease at any time or situation if any third-party software license price increases or decreases like Softaculous, CloudLinux, LiteSpeed, SiteBuilder, cPanel, Plesk, CWP, etc. In some cases, if third-party or base software or application price increases or decreases then existing customers or new customers & whoever will or had purchased our hosting has to pay extra cost expenses because our pricing is dependent on all these third-party software licenses.

Refund Policy:

You can cancel your hosting plan within the first 7 days for a full refund. PayPal, GST, Set-Up, and Handling Fee (if charged) will be deducted. Other Payment Gateway transaction charges (if charged) will be deducted.
For VPS, Setup Fees & Control Panel Fees will not be refunded. Refunds for VPS will not be processed once the server is deployed and delivered. You can request for VPS Refund before deployment.
This is because our VPS Plans are very cheap and a part of a huge amount is paid to the Data Center when you place a VPS order.

1) The money-back guarantee does not apply to most add-on products like Domains, WordPress Installation, WordPress Themes, Optimization, Script Installation, etc.
2) If you cancel within 7 days and your plan includes free months, Firstveda & its Subsidiaries will deduct the fee for Free Months.
3) Firstveda & its Subsidiaries, do not offer any refunds for cancellations that occur after 7 days.
4) There will not be any refund if a violation of the Terms of Services is found.
5) In most cases, refunds are done back to the source of payment. Ex: If you paid through PayPal, we shall refund you to your PayPal account.

Invoicing:
Firstveda & its Subsidiaries generates invoices 10 days before your due date.
Firstveda & its Subsidiaries reminds you about your invoice by sending reminders to complete your payment.
We suspend accounts on or after 1 day of the due date and send a notification on suspended Accounts.
So, we provide a total of 10 to 12 days to complete the payment before the due date.

Billing:
We have two payment gateways,
For international, we have PayPal. For Indians, we have Instamojo.
Our staff is not allowed to accept payments directly in their personal account/UPI. A customer is required to make payments using the invoice created.

Payments:
While ordering, you automatically establish a payment agreement with us Monthly/Quarterly/Semiannual/Annual Billing Cycle which we call Billing Agreement.
You can not skip your Billing/Invoice, no matter your account got suspended or terminated.
If suspended, that is your fault because you didn’t complete the payment.
If terminated, that is your fault because our system automatically terminates accounts after 60 days of non-payment, considering the violation of the Billing Agreement.

Why pay if suspended?
It’s not like you didn’t use it and you have to pay. You must pay because various licenses are activated, space is allocated to your domain when your order is activated with us. Even if your account is suspended, we keep your data safe and secure. Your data occupies space on the Disk. So you can’t say that you haven’t used the Service even if your account is suspended.
You must accept that your account got suspended because you didn’t complete the billing agreement.

Why pay if terminated?
If your account is terminated, you can request for deletion of the Service and you can place a new order again (using the same domain). You won’t be able to place an order using the same domain unless your previous order is removed.
If you want to continue with the previous order only, then you need to clear all your previous bills.

Even if your account is Terminated, we kept your data safe and secure until the last day. Your data-occupied space on the Disk and Licenses were also active for your account. So you can’t say that you haven’t used the Service even if your account is Terminated/Suspended.
You must accept that your account got Terminated/Suspended because you didn’t complete the billing agreement.
You also accept that you ignored all the emails sent by us to inform you regarding the Suspension of the Account due to non-payment.

Unlimited Policy:

• What do you mean by  “Unlimited”?

What we mean is, you don’t have to worry about disk storage or network transfer when your site gets popular.

You DO still have to worry about plenty of other things though… if your site isn’t well optimized and is causing issues for others on your shared server (either because it’s pounding the CPU, hogging RAM, or doing tons of disk I/O), you may be asked to sign up for your own FirstVeda Server.

Trust us, every host out there has exactly the same limitations… we’re just trying to be upfront about them!

• What about databases?

You’re certainly allowed an unlimited number of MySQL databases, but in the interest of server stability, we request that you try to keep them optimized and no larger than a few GB in size.

• …and Unlimited email?

The Unlimited Policy doesn’t apply to email. Any new email addresses will have a 5 – 15 GB limit, and we’ll be enforcing these limits on all accounts if it gets out of hand!

What’s not allowed in “Unlimited”?

Basically, sites whose essential purpose is to use disk or bandwidth. When making a website, you should be thinking about “How can I make an interesting site for my visitors while minimizing my disk storage, bandwidth, file system, memory, and CPU impact as much as possible?”

The result will be a better experience for your visitors, your web host, and yourself!

Here are some specific examples of things not allowed:

*Copyrighted content to which you do not hold usage or distribution rights.
*File upload / sharing / archive / backup / mirroring / distribution sites.
*A site created primarily to drive traffic to another site.
*Making your account resources available (whether for free or pay) to the general public.

FirstVeda reserves the right to delete data stored on our servers that violates any of the terms in the Unlimited Policy, and, generally, in our Terms of Service. FirstVeda has sole discretion to determine what does and does not violate either policy.

Actions Taken by Firstveda & its Subsidiaries:

The failure by a customer to meet or follow any of the terms & conditions is grounds for account deactivation. Firstveda & its Subsidiaries will be the sole arbiter as to what constitutes a violation of the term & condition. Firstveda & its Subsidiaries reserves the right to remove any account without prior notice and to refuse service to anyone at any time. Depending on the severity of the violation, Firstveda & its Subsidiaries may, at its sole discretion, restrict, suspend or terminate a customer’s web hosting account and/or pursue other civil remedies. If such violation is a criminal offense, Firstveda & its Subsidiaries will notify the appropriate law enforcement authorities of such violation. Firstveda & its Subsidiaries does not issue credits for outages incurred through service disablement resulting from Term & Condition violations. Firstveda & its Subsidiaries customers agree to indemnify and hold Firstveda & its Subsidiaries harmless from any claims resulting from the use of our services that damages them or any other party.

Customer’s Valid Contact Details:

The customer’s contact details must be complete and correct with a valid phone/mobile number. Our team reviews every customer profile and if they find any profile details incomplete or incorrect they may ask the customer to provide valid documentary proof of their identity and address proof e.g. Citizenship proof, Voter ID, Pan Card, Social Security Card, Aadhaar Card or Passport, in case of international customer it must be a Passport only. We may temporarily suspend or permanently terminate the customer’s account if their contact details are incomplete or incorrect and if they fail to provide the requested documents, Firstveda & its Subsidiaries may terminate their account and there will not be any refund in that case.

• Having incorrect/fake names, mobile numbers, company name/address, or addresses filed on your account. For Ex: A name like Aaadfdf Ffdfsf or an address like 44444444 Parck Rd. This tells us that you have not read our TOS and do not respect the service.

Q: Are adult sites allowed on Firstveda & its Subsidiaries?
A: No.
Q: Am I allowed to offer business opportunities or sell products or turn my site for money-making purposes (including placing ads like Adsense, YPN, etc)?
A: Of course you can.
Q: Is my personal info safe with you? Are you going to sell my email address?
A: No way! People are so busy running their lives that the last thing you, we, or anyone wants is worries to stop leaking personal info to anyone, which will likely be used for spam. Your privacy is totally respected with ZERO interest now or in the future to reveal your details to anyone.
Q: Are there any limits to the number of files that I can host on my server?
A: No.
Q: Will ads ever show on my free account?
A: No. We will not put any banners or text links to your free hosting account.
Q: Will my site ever get deleted?
A: If you violate any of the following your hosting account will automatically be deleted:

* Phishing
*Spam
*Use of your account to hack others
*Using account mainly as file storage
*Hosting proxy/torrent scripts
*Selling pharmacy pills/drugs
*In any other way violation of TOS.

Q: My site was suspended but I am following all the terms and agreements, what can I do?
A: We apologize for the inconvenience. Contact us to get this sorted out.

Q: Can I get hosting with free domains?
A: Yes, we accept free domains also. But we advise on using Paid Domains as Free Domains are not considered good for SEO and other Security reasons.

Legal:

The laws of India will govern this agreement. In any event of a dispute, the area of Jurisdiction would be Begusarai, Bihar (INDIA) only.

We support your Freedom of Speech and expression; however, we ask that you understand that responsibility is associated with this right. These terms may be changed at any time without notice to you. You agree that all changes after your signup still fully apply to you and it is your responsibility to check the terms of service often.

We reserve the right to modify these terms and conditions.
